WebEd: What Contractors & Their Attorneys Need to Know About Terminations of Construction Contracts - Liabilities, Challenges and Recovery

Description:  

Gain a better understanding of respective rights and responsibilities when encountering a termination for default or a termination for convenience of a construction contract. The webinar will cover contracting in both the private and public sectors. Key Federal Acquisition Regulation (FAR) principles will be highlighted as will relevant provisions utilized in AIA, ConsensusDocs and other proprietary contracts, including analysis of applicable case law. Issues include:

• Basis and requirements for termination
• Termination processes and notifications
• Potential defenses and recoveries
• Potential liabilities
• Appeals

The webinar will facilitate a better understanding of terminations (and how to avoid them when being terminated for default) in order to minimize damages and maximize recovery under a termination for convenience or termination for default.

Learning Objectives:
  1. Understand the respective rights and responsibilities when encountering a termination for default or a termination for convenience of a construction contract 
  2. Analyze key public and private sector contract termination provisions
  3. Identify potential defenses, recoveries and liabilities
  4. Unerstand appeals process, rights and responsibilities 

Contunuing Education Credits: 

1.0 AIA Learning Unit | The Associated General Contractors of America (AGC) is a Registered Provider with The American Institute of Architects Continuing Education Systems. Credit earned on completion of this program will be reported to CES Records for AIA members. Certificates of Completion for non-AIA members are available on request.

 

 

CLE Information: 

All Participants must be registered for the program in order to be eligible for CLE credit.

The ABA will seek 1.5 hours of CLE credit in 60-minute states and 1.8 hours of CLE credit in 50-minute states in states accrediting ABA live webinars and teleconferences. Credit hours granted are subject to each state’s approval and credit rounding rules.

NY-licensed attorneys: This transitional/non-transitional CLE program has been approved for newly admitted and experienced NY-licensed attorneys in accordance with the requirements of the New York State CLE Board for 1.5 New York CLE Credits.

The ABA does not seek direct accreditation of live webinars and teleconferences in FL, ID, ME, NE, NJ, OH, PA, PR, RI, and WY. Some states allow attorneys to earn credit through reciprocity or self-submission. View accreditation information for your state at www.americanbar.org/mcle.

If you cancel your registration at least ten (10) days prior to the webinar, AGC of America will provide a full refund. No refund will be provided if you do not meet this deadline, however you may transfer your registration to another employee within your organization. AGC of America will provide all registrants with a recording of the webinar and the PowerPoint slides following the program.
