FAR Council Proposal Would Identify Federal Contractors that Report GHG Emissions

On May 25, the Federal Acquisition Regulation (FAR) Council issued a proposed rule that would require some federal contractors to indicate whether they publicly disclose greenhouse gas (GHG) emissions and reduction goals or targets. Comments are due by July 25, and AGC is reviewing the proposed rule to assess implications for general contractors.

The proposal comes as a result of President Obama’s 2015 Executive Order 13693, Planning for Federal Sustainability in the Next Decade, wherein the seven largest procuring agencies—i.e. Department of Defense, General Services Administration and Department of Veterans Affairs—are to implement procurements that take into consideration contractor GHG emissions.  In order to access the scope of the supply chain that currently publicly discloses GHG emissions, the proposed rule would require contractors that receive $7.5 million or more in federal contract awards (in the preceding federal fiscal year) to indicate whether they publicly report emissions.
