Tighter federal budgets and increased skepticism by federal agencies about contractors’ proposed modifications costs have created an unhappy playing field where contractors are directed to perform changes that the Government won’t agree to compensate. While on the one hand the Government holds the purse strings, the federal Contract Disputes Act enables contractors to recover their full claim amount – with interest and some attorney’s fees for small businesses – if they can navigate the process successfully. And, unlike many private developers and commercial clients, when you beat the Federal Government at trial, you know you will get paid. This program will touch on strategies to expedite the claims process and maximize the opportunities to obtain a favorable settlement or – when the Government won’t settle – victory at trial.
During this webinar, federal construction law attorney Dirk Haire, co-chair of Fox Rothschild LLP’s national construction law group, will discuss:
• The differences between requests for equitable adjustments (REAs) and Contract Disputes Act (CDA) claims;
• Procedural strategies to expedite claims resolution and the appeals process; and
• Timing, Legal and Consulting Costs, and Likelihood of Success considerations related to appealing claims at the Boards of Contract Appeals and U.S. Court of Federal Claims

- In the area of federal construction, Dirk assists clients with bid protests and claims litigation involving such issues as constructive changes, delays, accelerations, defective work, differing site conditions, default terminations, past performance evaluations, defective specifications, the Administrative Procedures Act, the Americans with Disabilities Act, the Anti-Kickback Act, the Buy American Act, the Civil False Claims Act, the Miller Act, the Prompt Payment Act and the Truth In Negotiations Act. He also regularly counsels federal contractors on teaming arrangements; small business and set-aside strategy and compliance (8(a) contracting, ANC, NAC, HUBZone, SDVOSB); Federal Acquisition Regulation business ethics, conduct codes and compliance; DCAA audits and investigations; cost allowability and the Cost Accounting Standards; lobbying restrictions and disclosures; project labor agreements; Davis-Bacon Act compliance; subcontracting plans; best value procurement strategy; and debriefings. Dirk represents clients in connection with federal protests and litigation in the Boards of Contract Appeals, Court of Federal Claims, General Accountability Office, U.S. Court of Appeals for the Federal Circuit and various U.S. district courts. These projects involve U.S. government projects throughout the United States and the world, including Afghanistan, Iraq, Russia and Africa.

Follows issues involving federal procurement and budget, labor and safety, the environment and taxes that impact federal construction contractors. Prior to working for AGC, Jimmy worked for K&L Gates, an international law firm, the American Road & Transportation Builders Association and five U.S. Senate campaigns. He graduated manga cum laude from University of Pennsylvania and cum laude from the University of Maine School of Law, where he served as the managing editor of the Maine Law Review and was a member of the bankruptcy law moot court team. He is licensed to practice law in Virginia, Massachusetts and the District of Columbia.
